"Charitable status vs not for profit"
 
   Hi everyone,

I am part of the management team for a new band in Northampton which will be launched in September this year. We are spending some time putting in place the policies and procedures which we will need for the future. My question, therefore is:
Is it better for our new band to be registered as a charity or to run as a not for profit organisation? I have looked at the Charities Commission website and it looks as though we will have to have an annual income of £5000, so it may not be possible for the time being (especially as we haven't raised any money yet!). Have other bands been able to apply for grants without being charitable organisations?

Thanks in anticipation. Looking forward to being back competing next year.

Good news that you are starting a new band in the autumn.We have been contacted by several people in the past few months who are hoping to start up new bands soon.

Only just read your message re charitable status. As one of the earlier guys said, it is amazing how quick you will accumulate £5,000 worth of kit.

We have a fast track charity constitution for bands that has been agreed by the charity commissioners. We also have packs of info for new bands, including a DVD. The packs were put together in 2001, but are still relevant. We will shortly have a new 4 minute DVD suitable to presentations. Contact the Federation with postal address if you want me to send these to you

   Hi,Firstly the best of luck with the new band, its a big step. As to your question, you do not need to be registered as a charity to gain access to grants etc. You will need to set up a formal committee:-
Chair/vice chair, secretary,treasurer etc and lay out a constitution setting out the aims and intentions(teaching young people music and movement, self disciplin, that sort of thing)also something along the lines of in the event of the demise of the band and funds balance remaining after all are paid(Fees bills debts etc)would be donated to a charity. Its not chapter and verse but it kept us going for a good few years and its somethiong you will need to supply copies of when you apply for any grants. I am not sure but I believe there is or was a maximum ammount you could raise in a year before you had to register but I am not sure if that still applies.There were also many restrictions on what names you could and couldnt use. ie we were the Prince of Wales Marching Band. That would not be allowed if we were registered. It might be worth consulting a solicitor to set out your constitution and any other legal matters you may not be aware of or even have overlooked and dont forget your public liability insurance and for your kit and uniforms. Believe me it doesnt take long to amass £20000 worth of stuff and it can be gone in a flash. Brass Band Insurance Services we found were very reasonable and were specialists in the band market place(any type of band)Hope thats of some use, if I can be of any further help pleas ask Richard.

   Hi DM, we sincerely hope it will be a need breed of band. Hey, rumour has it you are rather good at twiddling sticks - we could use someone with your stick twiddling skills!!
